TERMS & CONDITIONS FOR SPEEDPOST WORLDWIDE ISLANDWIDE SERVICES
1. Duration of Service
1.1 Unless otherwise stated,the service shall be in force from the date of commencement of service for a duration of twelve calendar months, and thereafter, shall continue in force from year to year unless terminated by either party giving to the other party 4 calendar weeks prior written notice to that effect.
2. Payment
2.1 The Customer shall promptly pay on demand all charges levied in respect of the service as shown in the Singapore Post official bill.
2.2 In the event any charges remain unpaid after becoming due, Singapore Post shall be entitled to charge interest on the unpaid charges at the rate of 12% per annum from the due date of the bill till the receipt of the overdue payment and may terminate the service forthwith without prior notice whatsoever and without prejudice to its other rights and remedies.
3. Charges
3.1 The charges for Speedpost Worldwide and Islandwide Services shall be at the rates prescribed by Singapore Post from time to time.
3.2 The Customer shall furnish to Singapore Post an adequate banker’s guarantee from an approved bank, or a cash deposit of equivalent amount in lieu of a banker’s guarantee, before provision of service for the due performance of the terms and conditions hereof.  The Customer shall also accept Singapore Post’s rights, from time to time, to revise the quantum of the banker’s guarantee and demand additional bankers guarantee or additional cash deposit.  The banker’s guarantee or the cash deposit, as the case may be, shall be used to offset any outstanding charges owing by the Customer to Singapore Post or any sum that may become payable by the Customer to Singapore Post by reason of any breach of the terms and conditions hereof before the balance, if any, shall be refunded free of interest thereon by Singapore Post.
4. Customer’s Responsibility
  The Customer shall :-
4.1 provide Singapore Post at least three (3) working days’ notice for any changes in the scheduled collection.
4.2 provide Singapore Post with no less than the agreed number of articles in each accounting month and the total weight of individual article shall not exceed the respective weight limits indicated  in  the Postal Courier Services Guide.
4.3 promptly pay all amounts due to Singapore Post on demand.
4.4 ensure that
   
(a) Every article is packed in a reasonably strong case, wrapper or cover appropriate to its contents, and so that no part of the contents can be removed without either breaking or tearing the case, wrapper or cover or forcing two adhesive surfaces apart, or breaking a seal.
(b) All contents of the article are adequately packed so as to protect against damage in the course of transmission and in particular, but not limited to :
(i) An article which is of a fragile nature shall be packed in a container of sufficient strength and shall be surrounded in that container with sufficient and suitable material to protect the article against the effect of such concussion, pressure and knocks to which postal articles are ordinarily exposed in transmission, and the article shall bear the words "FRAGILE HANDLE WITH CARE" written conspicuously in capital letters on the face of the cover above the address of the addressee.
(ii) An article which is liable to be damaged by bending shall be packed in a container of sufficient strength to prevent the article from being in transmission, and the packet shall bear the words, "DO NOT BEND"  written conspicuously in capital letters on the face of the cover above the address of the addressee.
 
(c) Articles prohibited by any law  in force in the Republic of Singapore and the country of destination for transmission by post will not be accepted by Singapore Post.
 
4.5  
(a)

For Speedpost              -
Worldwide

 
Ensure that every article comply with the terms and conditions specified for Speedpost Worldwide articles contained in the Information Sheet provided by Singapore Post for the respective country of destination.
(b)

For Speedpost              -
Islandwide

 
ensure that the articles are addressed accurately to any destination only within the Republic  of Singapore (including Sentosa Island) excluding the other off-shore islands.
 
4.6 be liable to Singapore Post and indemnify and keep Singapore Post indemnified at all  times from and against all demands, claims, action or proceedings by whomsoever made or preferred and against all damages, costs, charges or expenses (including reasonable legal costs) incurred, suffered or sustained by Singapore Post in connection with the service performed for the Customer.
5. Singapore Post’s Right, Responsibility, Liability and Non-Liability
5.1 Singapore Post  shall  take all reasonable precautions to prevent unauthorised persons from having access to the articles(s) or their contents and shall also take all reasonable precautions against loss of or damage to the same or their contents.
5.2 Payment of compensation, is limited to a maximum amount of S$60 per shipment for Speedpost Islandwide Courier and Standard services, on condition that Singapore Post is satisfied that the claim is justified in instances of loss or damage.
5.3 The liability of Speedpost EMS service is limited to S$150 for "Package" and S$60 for "Document Packs" or the value of the item, whichever is lower, in the event of the loss or damage to the item.
5.4 The liability of Speedpost Worldwide Standard service is in accordance with the International Postal Parcel regulations.
5.5 Singapore Post shall not in any case be liable for :
(a) Indirect or consequential loss or damage;
(b) Any loss or damage  arising:
(i) from its failure to perform any of its obligations under this Agreement if such failure is the result of circumstances outside its control including but not limited to the outbreak of war, any governmental act, explosion, accident, civil commotion, riot, industrial dispute, strike, lockout, stoppages or restraint of labour from whatever cause, whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other force majeure, fire, flood or any other act of God;
(ii) from insufficient or improper packing or addressing;
(iii) from any loss of secrecy in communication arising from the use of the service.
(iv) from the hazardous fragile or brittle nature of the mechanical derangement of the goods;
(v) from failure by the addressee to take delivery within a reasonable time; and
(vi) as a consequence of delay or confiscation by any competent authorities as a result of the discovery of prohibited contents.
 
 
5.6 Singapore Post will notify the Customer of the collection time of the article upon approval.
5.7 There will be no collection and/or deliveries on Sunday, gazetted Public holidays and Saturday afternoons.
6. Claims
6.1

All claims for loss or damage must be made within 14 days from the date Singapore Post accepts the items. Such claims must be made in writing, accompanied by the original copy of the consignment note and should be submitted to:

7. Notices, Etc
7.1 Any notices, demands or any other correspondences whatsoever shall be deemed to be communicated to the Customer if the same is sent by ordinary post to the address provided herein by the Customer, or such other address as the Customer may inform Singapore Post of in writing prior to the dispatching of any notices, demands or any other correspondences whatsoever.
8. Applicable Law & Disputes
8.1 This Agreement shall be subject to and constructed in accordance with the laws of the Republic of Singapore. All proceedings in relation to any matter in dispute arising out of or in connection with this Agreement shall be commenced in the courts of the Republic of Singapore and the parties hereby submit to the exclusive  jurisdiction of such courts.
8.2 For the avoidance of doubt and without prejudice to sub-clause 8.1 hereof, it is hereby agreed and understood that this Agreement shall, notwithstanding anything contained herein, be subject to the Postal Services Act 1999 (No.42 of 1999) including any statutory modification or re-enactment thereof and any rules and regulations made thereunder and any directions whatsoever which the Info-Communications Development Authority of Singapore has given or may give to Singapore Post or  under any provisions of any licence granted by the Info-Communications Development Authority of Singapore.
9. Stamp Duty
9.1 Stamp Duty, if any, payable on this Agreement, shall be borne by the Customer.
